John’s pistol permit was reinstated after a few weeks. Attorney Berke filed a 1983 federal civil rights action against the Shelton Police for false arrest. The city settled the civil rights case.

Although he did not have a pistol permit, after a motion to dismiss, the trial court Judge Lubbie Harper, Jr, dismissed the charges. (Judge Harper later served on the Connecticut Appellate and Connecticut Supreme Court.) The State appealed and the Connecticut Supreme Court determined that, although the statute did not mention that a place of business must be a fixed business, that is what the legislature meant when they drafted the law. Upon remand to the trial court, the state agreed to reduce the charge which carried a mandatory minimum jail sentence to an unconditional discharge on a single misdemeanor charge.
